Alternative Dispute Resolution

RATIONALE

Alternative Dispute Resolution (ADR) is particularly a useful course for participants involved in conflict management departments or non-adversarial dispute resolution in relation to labour matters and commercial settings. The course focuses on the three main dispute resolution methods; arbitration, negotiation and mediation. It introduces the basic principles and techniques of dispute resolution methods in areas of labour relations, construction contracts or international commercial transactions.

PURPOSE

This course aims to provide participants with a theoretical and practical understanding of alternative dispute resolution.

LEARNING OBJECTIVES

At the end of the course, participants should be able to:

  • Acquire thorough familiarity with the various dispute resolution methods that are alternative to traditional methods on theoretical and practical levels.
  • Acquire skills, procedures, techniques and characteristics needed to engage in the various forms of alternative dispute resolution.
  • Recognize specific issues within ADR and their impact on the process, client, the practitioner and appropriateness of the ADR

  • Recognize the importance of the ADR within Botswanaโ€™s justice system.
